TERMS OF USE

The Photographer” is Ellen Steele. “The Client” is any person, body of persons, firm, or company with whom the Photographer enters into a contract for the sale of goods or provision of services by the Photographer. The content and images used on this website are the property of and copyright by Ellen Steele, D.B.A. Ellen Steele:Lifeshots Photography. Certain images may be utilized on other websites through a written agreement with Ellen Steele. Unless downloading an image for purchase, no images or content may be copied, duplicated (including taking screen shots) or otherwise taken from this website without express written permission from Ellen Steele. In addition, Client may not edit or modify the photographs in any way. This includes, but is not limited to, removal of watermarks, cropping, or using filters.

The Client is obtaining prints and jpeg files for personal use only, and shall not sell said prints or jpegs. If Client is obtaining a print or jpeg for newspaper announcement of the event, editorial use or website, Ellen Steele authorizes Client to reproduce the image in this manner. In such event, Client shall run a credit for the Photographer adjacent to the photograph.

By paying Ellen Steele to be your photographer, you are trusting her artistic vision and trusting her to select the best photos from your session. Ellen Steele reserves the right to edit images according to her knowledge and expertise. Requests for significant edits (including work that requires liquification, compositing, removal or addition of content, changing the shape of a body or the color of hair, etc.) shall be done according to Ellen Steele's recommendations as discussed with Client. Ellen Steele shall edit images one time only after a proof consultation with Client: these edited images will be the final images. Any edits by other individuals to digital files will void contract and close gallery from future re-openings.

If the Photographer cannot perform the contracted work due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, Ellen Steele: Lifeshots Photography shall return deposits or monies paid to the Client to date for the specified session or event, but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, Ellen Steele and Ellen Steele: Lifeshots Photography shall not be liable for any amount in excess of the retail value of the Client’s order.

With the agreement of the Client, Ellen Steele may substitute another competent photographer to take the photographs in the event of her illness or other reasons stated above that would prevent her from performing her duties. In the event of such a substitution, Ellen Steele may not be held liable for this photographer's image quality, personal conduct or business practices. Ellen Steele promises to make every effort to capture specifically requested event images. However the Photographer will not be held liable for photos that she was unable to capture for any reason.

Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon the deterioration due to such inherent qualities. Additionally, The Photographer is not responsible for inevitable low-quality resulting from Client printing from any and all non-professional printing labs, including, but not limited to Walmart, Costco, Walgreens, Target, CVS, etc. If Client desires to print images, Ellen Steele recommends printing from professional printing labs such as Bay Photo or mpix in order to receive highest quality prints. Only prints printed through Photographer will be guaranteed for color and quality.
